@Teri_Kanefield Stopping fascism will take more than sueing Fox? Getting money out of politics would be a good start? Ending Citizens United, and the ludicrous inequalitys sponsored by corporations are people too would help. Big money and fascism, are always obscenely connected, they sould get a room.

@Creditease This is a defamation case so the rules would be different from past cases. The governing law in a defamation case is New York Times v. Sullivan.

Because that worked so well for other fascists.And I think the lies serve to destroy trust in democratic institutions. @Teri_Kanefield Another Question:Why does it seem that everyone believes that Dominion's defamation hurdle is to be measured against the "public figure" standard?I'm not sure that Dominion is made a public figure simply because Fox and others threw lies at it.If that were true then defamation defendants could sometimes win by throwing their mud with even more force at the plaintiff in hopes of turning the plaintiff into a "public figure".

@karlauerbach I assume that's because at the stage of summary judgment, the facts are interpreted in light most favorable to the defendant.Should the case proceed to trial, I suspect that Dominion will argue that it is not, in fact, a public figure so the lesser standard holds.

@Teri_Kanefield Remember when Fox News won a court case by literally saying in court that Tucker Carlson isn't serious news and no one with common sense would actually listen him or take him seriously? They are about to do the same thing to wiggle out of this one, except this time around it will be in print that Fox went to court to say that they are in fact an entertainment channel and that no person with common sense takes their "news" seriously.

@PITTERSPLATTER Adding: I suspect another reason they are arguing the they are a news organization in this case (that's their defense) is because the First Amendment offers extra protection for the press. The First Amendment specifically mentions "the press."I hope I remember your questions so I can add them to the blog post next time I write about this case.
