So apparently some FBI agents wanted to put an end to the Trump Mar-a-Lago documents case but the DOJ insisted on moving forward. Here's the story, which I can offer free through my subscription: https://wapo.st/3kuBoTyBrandon Van Grack (https://twitter.com/BVanGrack) had an interesting take:While most people will focus on the tension between FBI and DOJ, the most troubling part is that people who knew about the dispute leaked it in the middle of a criminal investigation.

@Teri_Kanefield The article calls it a "raid" - I remember this being one point of rhetorical disagreement at the time, what makes something a raid, etc. The Right used that language to inflame and play Trump's persecution card. Maybe it was technically a raid, or maybe the journalist here has just bought into the framing the right gave it?

@steveportigal Steve, I think that the use of the word "raid" tells us who may have leaked the information. (Not that it was hard to guess which side did the leaking)

@Teri_Kanefield why is it troubling that we learn about this months after it happened ?surely this is something the public needs to know and will hopefully counter the insane idea liberals developed after 9/11 that the FBI is our friend

@timo21 This story was about MAGA moles in the FBI. There is no evidence that MAGA moles are gumming up anything at the DOJ.Here is your assigned reading topic for the day. (yes there is a quiz 😉 )https://terikanefield.com/all-new-doj-investigation-faqs/You are making two errors: (1) assuming anything is gummed up and (2) assuming there is evidence of MAGA moles. There might be such evidence but I haven't seen it.Let's talk again after you read the FAQ page.

@Teri_Kanefield that's how I understand it. Basically a channel I follow summed up that McCarthy is trying to get everyone off the hook by releasing this footage and that includes Trump. I dont know how plausible that is, and so now I'm questioning following this specific channel.

@Teri_Kanefield it's the Meidastouch folks. Essentially saying that the hours and hours of footage has been released in order to challenge convictions as well as challenge ongoing trials. It all sounded a bit too easy to me. Sucks not having the legal knowledge to be able to sift through this stuff and tell what is bs and what isn't lol.

@Teri_Kanefield @PITTERSPLATTER Unless they have footage of someone holding a gun to the insurgents’ heads and pushing them to commit the crimes, all of which are evident in other tapes (proof of their involvement/participation/guilt), the tapes do nothing for the defense. They do, however, give key information to the next attackers on where key safety points are, and that endangers everyone.

@Teri_Kanefield Thanks for the response. My error was conflating the FBI and DOJ in the assertion of MAGA-moles, since the public evidence is actually only FBI. I apologize for that. My evidence about MAGA moles is anecdotal. I was a fed employee until 2017 & had coworkers that were Newt republicans, then tea party, then slid to MAGAs. I even worked with a couple of 'sovereign citizens'. The civil service will have the same number of MAGAs as the general population. Some will be bad actors.

@PITTERSPLATTER I listened. I get the argument. The idea is that now all the people convicted have an appeal: They can say that the DOJ withheld exculpatory evidence. But this assumes that there WAS exculpatory evidence in that footage. Defense lawyers raise everything they can. That doesn't mean it succeeds.

@PITTERSPLATTER Funny, but I was thinking earlier that I feel so much freer to interact on Mastodon. If there was exculpatory evidence, then the DOJ screwed up. My mantra is that the worst the DOJ can do right now is make a mistake. That's why they really have to ignore the people yelling at them to hurry.

@PITTERSPLATTER Correct. Also the DOJ would have to have failed to turn it over.I had an appeal once, a dependency appeal (mother accused of abuse), so Brady didn't apply. I had evidence that the government withheld exculpatory evidence but lost on appeal because the error was not "harmless" (CA law is different, plus it wasn't actually a criminal case). In general I don't get all excited if the defense has an issue on appeal.

@Teri_Kanefield Yes, you are entirely right about the employment. Our predecessors in democracy created the Civil Service to stop to anything like that. That's why Trump's schedule F is so dangerous. Schedule F didn't get the attention it should have. Politicizing the bureaucracy would destroy democracy more than any supreme court ruling, IMO. https://www.axios.com/2022/07/22/trump-2025-radical-plan-second-term
