We find out precisely what the judge told the jurors about what they can and can't say.Remember, Georgia has special procedures (we have 51 jurisdictions, 50 states + federal) so what is true in one jurisdiction isn't necessarily true in the other.The judge told the jurors they can't discuss deliberations but can discuss anything else.Deliberations = any discussions without witnesses or the DA in the room.As I said earlier, just because something is legal doesn't mean it's smart. 2/

Team Trump pounced and said that the juror was out of line, etc. etc. Later they'll argue that her speaking tour was unfairly prejudicial and now they can't have a fair trial so the charges need to be thrown out blah blah blah.They will lose because she didn't do anything wrong and rules are rules and it isn't so easy to get criminal charges thrown out.But it will cause delay (and stress for people unaccustomed to criminal procedures).However (I am now pulling up my soapbox) . . . 3/

This is why I kept telling you all that Garland has to follow the rules and he was not going to listen to the very vocal former prosecutors in 2021 demanding that he reassure the public that he was investigating Trump.One job of the defense lawyer is to scrutinize each step the prosecution takes and look for prejudicial errors or rule violations.Defense lawyers love those because it gives them something to do on behalf of their clients.The quibble will be "what are deliberations."4/

Even IF the juror crossed a line, this does not mean that you get a case tossed out. I don't know GA law, but in CA error is not enough. You have to show harmful error and that's a steep hurdle.Interesting fact: Willis knew in advance that the foreperson was planning to speak to the media. She didn't comment so we don't know any more.In one clip, and seemed so smitten with "President Trump" that if anything she may have demonstrated that she's not a Democrat :)They found a nonvoter.5/

@Teri_Kanefield The vast difference between "can" and "should."One account I read said she repeatedly consulted notes of the rules to be sure what she could answer. Seems like she made a good faith effort to toe the line, but probably lapsed a few times with "too clever by half" hints at answers.At the end of the day, though, if there is a trial every prospective juror will know the defendant was indicted; the prosecution thinks it has a case & they can excpect to see the evidence she saw.

@Teri_Kanefield this grand jury can’t even indict so I doubt she did anything at all to hurt the case. What she did was hurt Trumps narrative and that is ok by me. The facts will indict Trump and they are pretty damned clear. I think Fani Willis can use the indictment threat as leverage.

@Teri_Kanefield thanks. I noticed the foreperson seemed Star-struck when she talked about Rudy Giuliani and Trump and a bit immature. She seemed easily baited with questions. Of course, Trump will appeal. Only thing he’s good at but he has lost at the Supreme Court.

@shoq Georgia has different rules and different procedures than the federal system or CA. Her behavior would be against the rules in either jurisdiction where I've practiced.So the answer is no, but possibly because I've never practiced in Georgia.

@Teri_Kanefield @amaditalks I must say, though, that I once needed a criminal defense lawyer for a family member in a town neither of us lived in or knew lawyers in. I called the prosecutor's office and asked the receptionist if anyone had gone into private practice recently, figuring they would recommend the lawyer who had treated them well, but who generally had a good reputation in the office, so their connections would be live. Worked like a charm. My relative got deferred adjudication.
