For @deeplyaware and others asking: Yes, Fani Willis now presents the evidence to a regular grand jury.Issuing indictments is up to the GJ. The reality: The prosecutor decides how facts are presented to the GJ (the defense doesn't make its case). The cliche among defense lawyers is that a GJ will indict a ham sandwich if a prosecutor asks for it.The idea is for the GJ to provide a check on the prosecutor's power, so presumably the GJ would refuse absurd indictments.A GJ is now seated.

@Teri_Kanefield thanks Teri. Of all reporting I’ve seen, this info was left out.

@Teri_Kanefield > The idea is for the GJ to provide a check on the prosecutor's power, so presumably the GJ would refuse absurd indictments. It *has* happened in history. CA has largely dispensed with that extra rigmarole, presumably on the theory that there are other checks in place to prevent abuse. Improves costs and efficiency. Have there been studies showing any difference in the fairness of the process?

@Teri_Kanefield @deeplyaware hasn’t the regular GJ been in session for a while now? (I thought I read that in GA the grand jury was always seated, and a new one will be seated in March).

@Teri_Kanefield @deeplyaware@mastodon.onlinedoes anyone know why board of elections or secretary of state offices aren't suing election deniers for slander and/or libel?

@Teri_Kanefield @deeplyaware my take on the “ham sandwich” trope is that a prosecutor won’t likely bring a case to the GJ that they are going to reject. Would be a waste of everyone’s time.

@Teri_Kanefield thanks teri. i knew of those but the state offices that conduct and confirm the elections should sue also. for example, i'm in nc. so our board of elections should sue--if our election results were being questioned beyond reason.
