#GeorgiaInvestigation **When I tell you what was reported today in Georgia, some may shout "lock them all up."Stick with me here. From Georgia: Tump’s campaign called nearly 120 Republican legislators to ask if they would appoint a slate of presidential electors who would vote for Trump instead of Biden. A log of those phone calls recently released by congressional investigators shows 30 Republican legislatures expressed "some level of support."https://www.ajc.com/politics/jan-6-documents-georgia-legislators-answered-trumps-call-to-overturn-election/LPFVDTZE7RCVPEW6UQKRXM575Y/1/

This was one leg of a complex plan, but this leg, by itself, wasn't illegal. What was happening here is the Trump campaign, advised shady lawyers, were advising the Trump campaign on a way to exploit a quirk in 1887 Electoral Count Act.In December the Electoral Count Act was reformed: https://www.npr.org/2022/12/22/1139951463/electoral-count-act-reform-passesBut as it stood in 2021, the Act envisioned two slates of electors being appointed from a single state.2/

@Teri_Kanefield i dont understand this line “What was happening here is the Trump campaign, advised shady lawyers, were advising the Trump campaign on a way to exploit a quirk in 1887 Electoral Count Act.” Is there a typo?

I assume you all know how the electoral college works.Anyway, states have laws requiring the candidate winning the popular vote in that state to get all the electoral votes.Under the electoral count act, it is possible for the state legislature and the governor to sent separate slates of electors, perhaps because they disagree or perhaps before the phone and Internet, communication broke down. The Electoral Count Act as it stood in 2021 lays out what then happens in Congress.3/

What happens in Congress, under the Electoral Count Act (ECA) is that the slate sent by the governor is given priority over the slate sent by the legislature. For more see Norm Eisen's testimony on why the ECA needed to be reformed:https://www.rules.senate.gov/imo/media/doc/Eisen%20Testimony.pdfSo at this stage, it could have been just like a protest vote from these legislatures, and perhaps cause some chaos in Congress, but resolvable under the law.Enter John Eastman and the plan for Pence to declare a genuine dispute.4/

For more on that, I wrote this up for the Washington Post. I can make it free through my subscription. There. Now you're all caught up. https://wapo.st/3lKUgO0I've been talking about the ECA, but here we are talking about Georgia law, which has separate statutes governing election interference. For a legislator to "show interest" in voting for a separate slate of elections is probably by itself not illegal. It's missing both requirements for a crime: Act and mental component.5/

@Teri_Kanefield what's your take on the Moore v Harper ISL (and for extra credit, the NC Supreme court choosing to rehear the cases at issue at the state level months after the majority switched)

But given that Trump and the MAGA Republicans have been losing state wide elections in Georgia, there should at least be political fall out from this. Also, if any legislators were more involved in creating fake electors, they could have some criminal liability. The thing to notice about the entire electoral-Eastman scheme: Trump has always looked for was to manipulate loopholes. He thinks he is clever to do so. His father got away with it. . . 6/

Did you all know that his father was hauled before the Senate in a probe of public corruption?Well, I'll tell you the story. Trump's grandfather (who has his own shady story) had a premonition that Queens would see a building boom, so he bought land. When Returning World War II soldiers were eligible for home loans under the new GI bill. This created a need for single family home, Trump's father took advantage of FHA loans, which allowed builders to recoup part of their expenses.7/

He found ways to cheat. He set up shell equipment companies. He rented himself equipment at inflated prices and billed the government for tacked on expenses that he never incurred. When he submitted costs for reimbursement, he added a 5% architect’s fee, even though there was no architect. He submitted falsely high estimates, did the work for millions less, and pocketed the difference.Sources:8/

When he was hauled before the Senate probe into public corruption, he escaped punishment because, at the time, there were no specific laws against what he did. Now there are. It was clear from Fred Trump’s testimony in front of the Senate that he thought himself clever for finding “loopholes.”Trump looks for lawyers to help him find loopholes. The problem for Trump is that this time, the scheme itself was illegal. It's complicated with lots of parts, but ultimately breaks laws.9/

@Teri_Kanefield Georgia remains very Republican. The game is to lean toward Jim Crow without going full Trump, and thus to accomplish racist aims while pretending to be just pro-business.

@Teri_Kanefield In my head I've given Willis until March to get an indictment out. That seemed a sufficiently reasonable amount of time. Speaking as a lawyer, I want Eastmen and all these other ones disbarred as well as prosecuted. I know those processes have started but...can we hurry it up?!

@Teri_Kanefield Yes!!! And I learned about the organization of lawyers that is filing ethics charges against all the Trump lawyers in each state where election lawsuits were filed. I forgot the name...maybe Project 66 or something like that.

@Teri_Kanefield@fulanigirl As a citizen of two parliamentary countries, I know how your electoral college works. It seems very undemocratic. Why can't you have a system like ours where the Prime Minister is elected by the political party controlling Parliament and who then effectively controls the legislature *and* executive until the next election unless their own party forces them out?</sarcasm>
