#USPolitics #law * * *A federal judge Monday said the Supreme Court's Dobbs decision may *not* have ended the constitutional right to an abortion. She wants briefing on whether the 13th amendment — or any other — might confer such a right.https://www.politico.com/news/2023/02/06/federal-judge-constitutional-right-abortion-dobbs-00081391Law professor Anthony Kreissaid: "This isn’t a terrible theory in the abstract but it is also dead upon arrival at the Supreme Court. Performative jurisprudence in the making."In other words . . . 1/

Nice theory, but no chance on succeeding with this Court. The solution is to elect enough Democrats in 2024 so that the Court can be reformed. There is much that Congress + the President can do to reform the Court and remain within the Constitution. There is no point, though, talking about it and giving the right wing slogans when there is no chance of getting anything like that through Congress.2/

@Teri_Kanefield @icymi_law is there a legislative path forward? If democrats hold Congress (significant enough majorities) and the WH, hopefully there’s a way to write new laws to protect?

@falconsview @icymi_law Yes, there are several possible legislative paths forward. For one thing, the Constitution allows Congress to add justices, which should happen.

@Teri_Kanefield @falconsview @icymi_law. But it won't with Republicans in control of the House of Representatives.

@wbtphdjd @falconsview @icymi_law That's why the solution is for Democrats to win elections with large enough majorities to reform the court.

@Teri_Kanefield @wbtphdjd @falconsview @icymi_law The problem is that many of us who vote for democrats get tired of them getting power and refusing to use it. Politicians play right into the corporatist media-infotainment complex, turning everything into bread and circuses. For example, I would send a card to all the Republicans with a picture of a trillion dollar coin bearing Obama's picture with the words go ahead and make my day. That's how you wield power and grab control of the narrative.

@Teri_Kanefield @wbtphdjd @falconsview @icymi_law Thanks Teri, great list, but I'm a relatively militant anti-theist and atheist. I'm regularly critical of religion, especially the abrahamic monotheisms. I've been suspended from multiple platforms for my critiques. Recently, I was called a bigot and suspended from the Daily Kos community. Mind you, I called Christianity evil, not Christians. That's not bigotry, but for the crazy left, I'm the villain.

@lednabm @Teri_Kanefield @wbtphdjd @falconsview @icymi_law that’ll kill your chances for sure. I remember the brouhaha that surrounded Kennedy’s election. A “catholic!” Horrors. No way is this country ready for an atheist politician.

@silviar @Teri_Kanefield @wbtphdjd @falconsview @icymi_law True... though I think there are 1 or 2 in Congress now. It doesn't matter, I prefer my privacy to fame. Though, I would like to try standup comedy at least once before I die. So, those years of George Carlin don't go to waste!
