The bit about a lawyer being stopped from entering a music hall in the US because its facial recognition system picked up that she's part of a law company that's suing them is even crazier than I thought.The law company isn't suing the music hall - it's suing a restaurant, in another state, which is owned by the hall's parent company MSG Entertainment. MSG gone ahead and harvested photos of all the lawyers in the firm and fed it to an image recognition system to ban them from every MSG Entertainment owned location.People always tell me that if you've got nothing to hide then you've got nothing to fear. @beccanalia it does not impede the law, they're just banned from getting service in venues owned by MSG. MSG however is being sued by multiple law firms over this very thing - it's all in the article.

@beccanalia I am not a lawyer but I imagine blocking a lawyer who is entering a building to do their job as a lawyer won't reflect well on whatever legal case the lawyer is dealing with.

@Polychrome I don't see a problem with this, she's part of an entity that is damaging the owner of the music hall and may be doing litigation research for a separate suit. Lawyers are not a protected class and should not ever be considered such. It's more efficient than having employees manually review a list of banned patrons, but no different ethically.

@MKSinSA that's not what the article says. Many other lawyers are banned and get stopped by the system. There are multiple open lawsuits against MSG due to this behavior.

@Polychrome In Australia and New Zealand there's a Facial Recognition system, #PatronScan used by bars to record photos and names and id cards so the bars can blacklist anyone who behaves badly. The Terms and Conditions don't specifiy an end date for use of the data nor how to challenge decisions to ban them. People keep saying “oh, the law firm should have informed her.” And I keep trying to tell folks that radio city music hall is a 5900 person capacity venue and the idea that they are this intense with surveillance using biometric data is beyond creepy. It also begs the question as to what other personal data has been collected on which individuals and why and where is this data is being stored. Holy shit, what the fuck is wrong with these people?! 😲🤦♂️

And IMHO concentrating on face recognition is steering the discussion in the wrong direction.The real problem is that MSG implemented a policy that disallows people who are just doing their jobs from entering their venues. Sure, MSG has all rights to allow or deny people entry, as it's their venue. But is it ok to deny people entry for this kind of reason?Face recognition was just a tool here.nothing more or less.

@attilakinali @Polychrome Facial Rec. is absolutely relevant here. It’s a great demonstration of abuses of #FacialRecognition technology. The denial of service would not be feasible w/out it. This story serves as inspiration to sign the #reclaimYourFace #petition in Europe. Though I have to wonder if this had been in Europe, would the #GDPR have protected the lawyer from the non-consentual data collection?

@koherecoWatchdog @Polychrome No, face recognition only made it efficient. It was possible before and without it to deny people entry into venues. Just distribute a list with pictures to a few employees and they can deny entry to the people on the list..In Europe, there is no need to go for GDPR, there is already the anti-discrimination laws that makes such broad bans illegal. And IMHO discrimination is what the discussion should be about, not the technology used.

@attilakinali @Polychrome Yes, but you’re neglecting the efficiency when in fact the efficiency is everything, as it crosses a threshold of feasibility. It’s *not feasible* to manually check the faces of a large number of people in the short amount of time they have to seat them.

@attilakinali @Polychrome Well, I guess I need to qualify what I said. The discrimination is against /a company/, not lawyers (lawyers of other corps would be allowed in). But still that’s not a protected group in the US (and even if it were, the protections only apply to certain transactions like employment or home buying). Perhaps you’re right that this variety of discrimination is banned in Europe.

If a banker refuses to give a home loan to someone with no income or means to pay back the loan, the banker is acting responsibly. Banks in the EU treat Americans very differently (forcing them to disclose foreign SSNs and agree to info sharing that non-Amercians are free of). That’s required by law. Some banks even outright refuse Americans. Yet at the same time this different treatment violates equality laws in Europe.

He could have grabbed a huge db of gay ppl’s faces from social media, then refused them business. Facial rec makes that possible. There is no data protection & no protection from discrimination in that scenario.
