remember how, just yesterday, the usual suspects were saying it's not surprising that the supreme court batted away challenge to biden's debt forgiveness plan because there's absolutely no theory of standing that could possibly work for any plaintiffs and no court in the country would take it seriously and so on?yeah...https://twitter.com/mjs_DC/status/1583587524504879104

this particular suit is the one by a group of republican states led by nebraska, in which they argue that they're injured because forgiveness incentives people to consolidate FFELP loans (not forgivable) into DLP loans (forgivable) and that will deprive the state loan servicing corporation of those loans as assets (having value to the state unto themselves) and the ongoing revenue generated by them. the suit also argues the states are injured by being deprived of the tax revenue from the to-be-forgiven loans.https://storage.courtlistener.com/recap/gov.uscourts.moed.198213/gov.uscourts.moed.198213.1.0.pdf

by any normal standard, that supposed injury does not give the states standing to bring a lawsuit—let alone cause "irreparable harm", the standard for an emergency injunction—which is why the legal commentariat said the suit was going nowhere.but whether it means the legal standard DOES NOT MATTER to republicans or their judges

tl;dr: standing is when republicans don't like what you're doing and the more republicans don't like it the more standing they have

@shadowfacts this does sound insane, but we also have precedent that growing your own wheat interferes with the interstate wheat market because you might buy less wheat.https://en.wikipedia.org/wiki/Wickard_v._Filburn

@shadowfacts I’m trying to figure out how they manage any standing considering they have no spine.
