Having looked at Wall's letter myself now, it seems to have an underlying assumption that the Executive Branch is the permanent bureaucracy, and whichever President happens to be elected, it doesn't really matter, if the Executive Branch bureaucracy advises the next President that they need to obtain a privileged document from a prior President for some reason, they can just have him waive the privilege of the previous President, because, after all, it's the same executive branch.

Basically, the theory is that a prior President can't assert executive privilege against the executive branch, no matter that its now run by a different guy. So the new guy gets to see everything the old one was up to, including the policy advice he was given. But as Prof. Dershowitz says, that doesn't really make so much sense, in terms of the policy argument behind executive privilege, which is meant to protect the confidential advice a President is given so that it will be candid.

@Monadnock I'm glad that Donald Trump seems to be interested in taking on the executive bureaucracy in more than just a temporary deregulatory fashion. That's ultimately the source of this conflict that threatens our liberties, the unconstitutional consolidation of power in increasingly unaccountable agencies.
