@SLAG On reflection, the constitutional crisis associated with the decertification of the election scenario (the first option) could be more severe than the PEADs scenario. At least with the PEADs the question of executive authority would be a fait accompli. With the decertification option, there would be at least some period of time where the question of executive authority would be unresolved, at least to some extent.Turbulent times ahead!

@SLAG Excellent article @SLAG. It never occurred to me that the J6 FF was used to stop the certification of the state electors. But now that you mention it, it makes a whole lotta sense. I also appreciate your analysis of the SCOTUS decision. It helps fit some of the pieces together. It also helps me understand what Trump said at a recent rally. He said something to the effect that SCOTUS would have bigger decisions to make soon. Thanks for sharing your work. I really appreciate it!

@SLAG I have a question regarding the SCOTUS part of your article. If there is no replacement confirmed because of all the Dems lack of power, how does this affect cases before the court??? If the election process goes before SCOTUS there could be a tie?? Or does the case have to wait until someone is confirmed and if it’s done by a Republican dominate congress won’t that look partisan??

@Kat Ok, if Breyer steps down and no replacement is confirmed, the court will have 8 seats filled out of 9. The court isn’t political 🙄 but going off voting history, we have2 Liberal votes5 Conservative votes1 Swing (Roberts)I don’t think an empty seat will change anything. Even if they fill it, it won’t change the political situation.If anything, the conservative wing of the court could slap Roberts around and issue decisions that rigidly follow the constitution

@Kat Will SCOTUS stop issuing opinions until the seat is filled?Nope. No reason to stop. They have a backlog as it is.The court can operate with 8 justices no problem, but there is a question of a theoretical tie.In that case, I think it goes back to the previous court, and whatever that opinion was is what stands.

@Kat So what would this look like in practice?Well now that there’s a 5-justice solid majority that are constitutionalists, that means that opinions will align with the constitution - quite rigidly.For example, NYSRPA V. Bruen - dealing with CCW in NY city - I see that as giving blue states quite the shock.

@SLAG I am as optimistic as they come and believe better days for America are ahead but I am also a realist. Not to temper the current/coming wins but we also have to be prepared for the casualties to come from this war. I am seeing in my personal life the health of many begin to deteriorate, (mostly older people who have been...you guessed it), but even when we win, some of us will lose.
