@Kite dude had been asked to leave and even though he called the cops already he decided to be mister big man and take matters into his own hands even though the other dude had a gun which he tried to take from him so he literally got what he asked for. "you better use it god dammit or i will take it and use it on you." if someone says that to you after you have come out with your gun and gets in your face, then tries to take it, yeah you are totally justified in shooting them REGARDLESS of whether you're breaking some custody law. doesn't even matter if the dude was technically trespassing or not. there was an imminent threat that had to be dealt with and whether or not that threat was spurred by the fact that there was a gun there is completely irrelevant. don't bring fists to a gun fight and especially don't tell the guy with the gun you're gonna' take it from him.play stupid games, win stupid prizes. he should have just let the police deal with it and taken them to court like he said he was going to, instead he tried to be macho against a dude with a rifle, nice job dumbass. get it on tape that he came out with a gun and told you to leave when it was your time to pick up your son, take them to court and maybe get more custody over your son if you're in the right. now you're dead, get fucked.

@Kite the only rationale i can think of for the dead guy to be in the right is just coming from a place of strict emotion where a fed up dad finally breaks and will do whatever he possibly can to get his son back or something, maybe the mother has a history of pulling shit like this and he's tired of it, but that's all conjecture and looking at it from an objective standpoint where i don't know anything about either party, i'm of the opinion that the guy had every right to shoot.there was also what was probably a warning shot but i don't know how texas law handles that. some places treat it as use of deadly force but at that point i'd think it would be null and void since the guy already threatened to take your gun from you and shoot you, so "using deadly force" is justified as it is a perceived imminent threat to your life.i can't imagine being in a position where someone fires a shot at me and misses after i've been told to get away from their property and then i try to take their gun from them instead of backing down and letting someone else handle it, that's wacky shit.on another watch it looks like the guy tries to go for the gun before the "warning shot" too, so yeah, dude's justified 100%. one might think he's a jackass too, but that doesn't change the justification, just like in the case of kyle rittenhouse. people thought he shouldn't have been there with a gun and that sparked everything, but he had every right to have that gun and nobody had any right to run after him. pretty much the same scenario here. guy had every right to have the gun, dead guy had no right to try and take it from him and tell him he'd shoot him if he got it.

@beardalaxy I think you are correct here. There is no rational or logical excuse why you would approach a man and try to take his gun after issuing a threat unless you yourself intent to sign your own death warrant. It is quite tragic that a son was robbed of his father, but one can only see such a circumstance as self inflicted by the father with all due consideration of the context provided.In a better world he would have been a better man by stepping back and understanding that there will be better days. God was with him how ever he took heed to his call a little more seriously than I believe was intended.May god rest his soul, and may his son recover.
