@wikifarms @josh consider these nuts, obviously there's no unified european criminal law but there is tons of similarities between the countries because they developed based on the same principles. I don't know about every single european country but I'm willing to bet that ne bis in idem is codified in all of them

@DieLawn @wikifarms Double Jeopardy is interpreted differently. You cannot literally be convicted of the same thing twice, but the US not being able to re-judge the same issue twice is a unique limitation.

@josh @wikifarms it's not, you cannot be charged (in at least all european countries that I'm familiar with, not sure about all) for the same issue, it's called ne bis in idem. If you break into a house and take something on tuesday the 13th you can get charged with burglary once, if they find you not guilty they can't charge you with theft the next day

@DieLawn @wikifarms I'll try one more time to explain this.Man is found guilty of manslaughter for participating in consensual cannibalism. Serves 5 years of 10 years.Man appeals. Judge believes, based on new information, he is actually guilty of murder because the other participant did not consent to be killed. Sentence is upgraded to 30 years, 5 of which have already been served.This is not double-jeopardy. This is re-litigation. In the US, re-litigation is not permitted, and appeals can be accepted only in the convicted's favor. The US's interpretation is unique.

@josh @DieLawn @wikifarms. The UK used to have double jeopardy, they got rid of it so they could retry a bunch of guys suspected of murdering a black teenager. Then just for good measure they got rid of Jury trials and the right to remain silent.
