@satori Jesus christ! That sucks they had to do thisHowever, Mr.Double thing has a few caveats. Firstly, that guy was an actual child abuser and rapist, which by extension made any of the stories he created CSEM. Also most of his audience was discovered to be other sex offenders and child abusers. He wasn't the only creator on the website and he allowed others to upload onto there. Meaning that content that came from actual child abusers could be considered csem hosted on his own site.

@satori so i'm doing a search and what I'm reading is he molested a 5 year old child and another woman whos assault he filmed, so that might've had something to do with the conviction by jury.a good lawyer wouldn't have allowed this conviction based on the 'trafficing of writings and art' charges

@wysteria2 Well, the allegations were substantial enough to be used in a court of law. My point was that the context of him being a rapist and abuser as well as his audience were used as the basis for convicting him. This was what allowed them to classify his content as Child Sexual Exploitation Material. If he was falsely accused and convicted, is an entirely different story.

@wysteria2 Too your second point, this is less about literal child abuse and more about child abuse material. Right now, American law askes a fundamental question based on obscenity and child protection laws: "Was a child sexually exploited to produce the material we are seeing?"That includes sexual explicit photographs and video of children, sexually explicit drawings of real children, traces of photographs with CP, stories depicting acts committed against real children.

@wysteria2 even though his story was largely fictional, the government had the grounds to say that the content was produced through the abuse of actual children. Is it a stretch? Absolutely! But the key here is to not abuse or use content made from the abuse of real children and you'll be alright.

@satori you know I don't think he was convicted based on the website. From reading the stories he was an IRL pedophile and abuser, however could not be convicted on those crimes due to the statute of limitations. So instead they charged him with this. No way someone gets 40 years for writing fiction. That said however, considering what he did in the past, I'm glad he's behind bars.

@satori you know I'm certain the sentence was based more on past crimes and not just the writing/hosting. From reading the stories he was an IRL pedophile and abuser so his sentence was much harsher. No way someone gets 40 years for just writing fiction. I think the craziest part was the supervised release following the prison time. It's like what are the odds he'll even be alive by then?! Anyway considering his past I'm glad he's been put away, hopefully for good.

@wysteria2 the America has different definitions of CP and CSEM. Any content produced as a product of child abuse is CSEM. His site hosted stories they deemed to be of this nature. If it was up to me, obscenity law wouldn't exist, but this is how it is
