THREAD for @OneLargeToe, who wrote:"If nothing comes of this audit, I'm going to be f'ing pissed."Some thoughts on that. When SCOTUS refused to hear a key case (for lack of standing) I was surprised but also very slow to read much into it.Didn't accept it on face value, nor did I read anything into it beyond the fact that it happened. It went onto a "We'll See" shelf: Cause yet to be determined, conclusions yet to be drawn.

What I TENTATIVELY concluded was that a conscious decision MIGHT have been made not to interfere in an area where STATE LEGISLATURES (READ = We The People of each State) had full plenary power. That, I thought, was a possible judicial RATIONALE for not hearing, which has nothing to do with any ulterior motives on their parts which MIGHT have been in play. Article II Section 1, USC reads, "Each State shall appoint, in such Manner as the Legislature thereof may direct..."

So EVERY THING leading up to (and following) the appointment of Electors is within their purview. FURTHERMORE - if there is foul play (i.e., Electors appointed in a manner in which they DID NOT DIRECT), the State legislature, IN THEORY, has the power and authority to both investigate AND DE-CERTIFY - post facto.

ONE MORE POSSIBLE JUDICIAL RATIONALEIF A LEGISLATURE DID NOT ACT, that COULD - again in theory - be viewed as their tacit acceptance of (implied consent for) whatever happened. Meaning that it's ALL on the State legislatures. Action OR failure to act is all seen as an exercise of their plenary power and therefore NON-JUSTICIABLE. IF, broadly speaking, that is/was the rationale, we now have an interesting dynamic at play in Maricopa.

The Democrat plaintiffs are looking to throw monkey wrenches into gears and sludge into the path of a potentially election-overturning juggernaut.Arizona Senate Republicans very wisely and publicly stated that they were only defending the accuracy of the November elections; that their actions were only to "dispel concerns that the results were inaccurate."

“Maricopa County elections were administered with integrity throughout 2020. That’s a fact. Multiple audits to date have proved as much, and multiple court rulings have concurred,” Chairman Jack Sellers said in a statement.“It’s also true that a significant number of voters want the additional assurance that a full forensic audit of tabulation equipment might bring, especially given all the misinformation that spread following the November 3 election,” Sellers said."https://www.theepochtimes.com/arizona-senate-passes-bill-strengthening-its-investigative-powers-amid-maricopa-county-vote-audit-dispute_3703145.html

The AZ Legislature's ducks are lined up. They have FULL INVESTIGATIVE AUTHORITY, without regard to other laws, retroactive to December 31st, 2019.I FULLY ANTICIPATE another JUDICIAL CLOWN SHOW, given what's at stake now in this ALL-IMPORTANT AUDIT.And it doesn't matter to me what happens, as it's ALL downside for the left.Delaying, crippling, stopping the audit will only REINFORCE what most ALREADY KNOW OR STRONGLY SUSPECT.

My question, assuming they get it jammed by judicial interference, and assuming further that it goes to SCOTUS (ON APPEAL BY THE AZ LEGISLATURE), will they hear it?IF they do, the outcome SEEMS clear enough to me: Non-justiciable by lower courts, State Legislature has the power - judgment vacated/remanded/overturned/whatever.That's IF the rationale is as I suspect.

So what if the ghouls succeed in shutting down the audit?NOT HAPPENING in my mind, but WHAT IF THEY DID?Do you think others in other states would just tuck tail and give up?FAT F****G CHANCE! Crapping on the AZ audit would only add insult to already serious injury.Across the entire country. The Trump base in ALL other states would be JUST as incentivized, IF NOT MORE, to see to it that it didn't happen in their state. And we might even see audits in states NOT in controversy.

ADDENDUM:And the reason why I selected this image for my initial post.I STRONGLY, STRONGLY SUSPECT that SCOTUS has been signaling to EVERYONE that there will never be another Bush v. Gore. They WILL NOT rule against anything involving the PLENARY POWER of another branch.AZ Senate could pick Sam the Butcher and Alice the Maid, who could BURN BALLOTS in front of everyone and make a mess of everything - and SCOTUS wouldn't touch it. Because it is AS THE LEGISLATURE DIRECTED.

@Julie No, I "THINK" that DJT wanted the win. That he really was disappointed by failures along the way - including (possibly) Pence's refusal to SEND IT BACK TO THE STATE LEGISLATURES.Because that would have been consistent with the rationale that I'm imputing to SCOTUS.There are many things attributed to Trump as deliberate (and brilliant) on his part. I see the brilliance in how he capitalizes on all of it. AS IF it couldn't be better if he willed it that way himself.

@Julie There is ONE reason why *I* think SCOTUS should have gotten involved, and that's the Catch-22 question of whether the State Legislature ITSELF was legitimately constituted. That is the ONE area I can think of where they could make an exception - AT THE VERY LEAST making a finding after hearing evidence - then STRONGLY RECOMMENDING that the State legislature act on that information.

@StevenDouglas @Julie It is very rational that Trump was well prepared but not Teflon and there were losses along the way. That would be realistic but he is the one man who can pull off the seemingly impossible. Much like the three hole batter in baseball, your best hitter in the clutch. I trust that God put him in this position for a reason. My faith is secured.

Not to mention the "Open California rallies" which were loaded with hundreds of Trump supporters. CA got scammed HARD.

@mainstem @OneRandomGuy The need/desire to see high level perp walks is something we have zero control over and I can't even address. It's almost like the banks that won't prosecute employees who steal because they don't it made public that it even happened.I can only say lucky for all of them that that magic wand is not in my hand. What I'm sensing is that all of this can, AND MUST, be addressed by the State legislatures and at the local levels. We have swamps of our own to drain.

@AmareVita @OneLargeToe I consider it a DISTINCT possibility, regardless "who's issue" it ultimately is. And the rationale I'm imputing to SCOTUS would fit both that scenario/narrative AND the Pelosi/Pence unconstitutional count in the absence of the dismissed quorum.

@Linnie @DougAdamavich I see most of them as anti-boat-rockers. The worst kind of conservatives in many ways, as they are NOT listeners and do NOT have their fingers on the pulses of their constituencies. I think most of the nutless ones saw Trump as dangerous to the party and the "delicate balance of power".Too volatile, gonna get us all in deep shit if he's not careful. As if we weren't already in the deepest shit for being too careful.

@StevenDouglas Great comment, Steven. You nailed it. They Just can’t think outside the box at all. Yep, a few said they just *knew* he was going to get us into another war. I mentioned ALL the peace he fostered in the ME and with Israel. They Didn’t care. I was furious.

@DougAdamavich True statement Doug. C. Rigidity. Never knew that term until Thomas explained. These types of *conservatives* are (to me) in the same category as the usual RINO politicians: worthless

@DougAdamavich I will admit that I walked into that booth (in 2016), and reluctantly voted for Trump. Cruz was my man. But...I watched what Trump DID and listened to him fighting back, which I was always scared to do. Not anymore! He taught those of us willing to break out of our Conservative Molds HOW to fight (figuratively)!I love him for that.

@DougAdamavich @pamby1 @StevenDouglas I don't, but I heard the swing states were ahead for Trump. For sure, California was headed in that direction.

@DougAdamavich @Lisa22 @pamby1 @StevenDouglas I remember that vividly. Was watching Saul & Fudge when it happened. Suddenly, ~ 1:15 am, 100,000 vote dropped for Biden in VA. Trump had been ahead in VA until then. 😐

@mainstem @OneRandomGuy Perp walks after the war. Just like WWII. Because a TOP DOWN DOJ swamp skimming is required. The DOJ now exists to protect and won't prosecute, let alone convict, one of their own. And they have gnarled-ass deep roots. So whatever war is won MUST be cataclysmic enough to go deep - or it's long game. GREAT satisfaction for winning the war, SLOW (and sometimes no) satisfaction on the final justice end.And I'm not in it for my personal satisfaction.Win the war.
