I highly doubt that the defense team wanted to concentrate on the unconstitutionality of the proceedings.Such a trial has precedent, but the Senate acquitted former Secretary of War William W. Belknap because so many senators said that it was an unconstitutional trial.The Republicans have already stated that they won't find Trump guilty no matter what, so the alleged Trump defense would be a waste of time.
