'No longer acceptable' for platforms to take key decisions alone, EU Commission says https://www.euractiv.com/section/digital/news/no-longer-acceptable-for-platforms-to-take-key-decisions-alone-eu-commission-says/This is in reference to some large social media platforms kicking users off. Frankly, I think it’s bullshit. What about their rights not to host content that violates their ToS? Are we just throwing away the whole idea of a ToS?

As the owner/admin of a small social media server, I don’t feel any obligation to host content I disagree with. They’re contending that I could get so many users that I no longer have the right to make that decision. At that point, I’d rather burn the whole thing down than be coerced into spending my own money to give idiots a platform. You have freedom of speech. I have the freedom not to be your soapbox.f

@tek If the ToS is unilaterally presented by an unaccountable party, and there's no realistic opportunity to negotiate terms? Yes, that's bullshit and we can throw away the whole idea.

@bignose But that describes me, too. I offer a ToS that you can either accept or walk away from.

Yes @tek, “a small social media server” is hugely different from the Amazons and Twitters and Facebooks of the world. Your small social media server does not constitute an effective global monopoly, that's what makes the difference.

@kemonine That actually doesn’t change the core of it much for me. A bad idea is a bad idea even if someone I like has it.

@bignose At what size is a service not allowed to decide what content to allow, particularly if they believe that content poses a physical risk to themselves and their neighbors?

Correct @tek, it's a spectrum. As a platform becomes a monopoly, they to that extent do not get to make decisions unilaterally because to that extent their decisions are no longer in the private realm.

@tek "For that matter, the presentation of an edited compilation of speech generated by other persons is a staple of most newspapers' opinion pages, which, of course, fall squarely within the core of First Amendment security" from: https://scholar.google.com/scholar_case?case=8332999881059454410&hl=en&as_sdt=2006&as_vis=1Basically, your whole platform is one big Op Ed. ... so is Twitter, FB, etc. The Platform is protected under the 1st amendment.

That would make sense, @bignose, if there were any monopoly social media platforms right now. There are several giants ones, but a whole awful lot of merely “large” ones. And regardless, much as I don’t personally like them, I full support the right of Facebook and Twitter to remove content or users that they believe is a clear and present real-world danger. That’s not about a disagreement of political views, but about not wanting to enable riots and insurrection.

@kemonine More cynically, maybe they’re worried that they might not be allowed to be as toxic as they’d like. And I simply don’t get the EU upset over Parler being deplatformed. So AWS should be required to host literal fascists, even if they don’t want to be? So odd.

@bignose @tek I'm ok with de-platforming people for planning murder. I don't think any platform, not matter how big, should be coerced into supporting crime. But I also believe you can provide a service that's so vital you shouldn't have the right to withhold it based on your own likes and dislikes. As Bignose says, it's a spectrum. Or as I would say, it's a judgement call. That's why we have judges

@bnmng @bignose I honestly don’t think that happened here, though. Note that Twitter booted Trump for encouraging violence, *not* for saying something they disagreed with. I think there has to be room for emergency response, too, that may not have time for courtroom evaluation. If some world leader said “kill all the X people”, then every minute counts.

@tek @bignose Then I think we might be in agreement, basically. You're right about the need for immediate action so when there is a reasonable expectation of violence then action should be taken. But the U.S. right wing is complaining about being deplatformed for their views. They're lying. They're being deplatformed for their calls to violence. If they were telling the truth I would support them even though I disagree with their views

@bnmng @bignose On that, I totally agree. For context, I wrote this a while back: https://blog.freeradical.zone/post/welcome-to-my-living-room/TL;DR I don’t care what you say and you definitely don’t have to agree with me, but my patience wears out when you start peeing on the rug and punching the other guests. For me, this entire episode was about words driving actions, and not at all about political views.I would not boot a user simply for being a conservative. I’d quickly boot a liberal who was being an ass.

@wolfteeth That’s really my whole point, especially when the example speech promoted a clear and present risk of physical harm. Like if Twitter and FB can’t even be allowed to say *that’s* not OK, then turn the whole thing off and let’s start over.

@tek @wolfteeth Twitter is a public company traded in a public stock exchange telling their shareholder they are advocating for free speech then censoring conservatives makes no sense and I am still looking for one Trump tweet that call for violence. BLM/Antifa on the other hand had a whole compagne on Twitter/FB called "Burn it down" and they did, so many small businesses and public buildings were destroyed yet no one was calling for deplatforming or censoring the BLM/Antifa groups. The hypocrisy is real!
