Significant problems have been identified with the current law which, in its essentials, dates from 30 years ago. These include:1. A lack of certainty concerning a child’s legal parentage for some months after hisor her birth, which may be contrary to the child’s best interests and incentivisesprospective intended parents to seek surrogacy arrangements abroad.2. @NordicModelNow I'm happy to forward the pdf letter to you if you have an email address you can DM me.I'm concerned that their analysis is skewed towards the rights of the adoptive parents, although there is at least some acknowledgement of the well-being of the child, but hardly any reference to the women being used to carry and birth these children. Indeed, the word woman doesn't appear until halfway through this long letter. There seems to be no equality impact assessment of how this law will affect all women. Those of us who are not mired in such poverty that we have to resort to selling our bodies for nine months are nonetheless impacted by being the same sex class as women who are. Why would chattel and breeding stock need human rights if we're not really human? 😡 I need to wait for my blood pressure to go back down before I can compose any sort of reply to this.One thing I wanted to challenge was the assumption about the numbers of women who will be targeted to use for their oocytes. The law commission makes the assumption that if the % has been low compared to 'traditional surrogacy' in the UK, that will remain so after the law changes. I don't think that can be so assumed. Do you know of any data from other countries showing a rise in the proportion of surrogacies that use an oocyte from a different woman than the woman used to gestate?

A lack of clarity around what payments can be made to surrogates under thecurrent legislative provision for “reasonable expenses”, which makes the lawdifficult to apply and enforce in practice.From 6 June to 11 October 2019, we conducted a public consultation on provisionalproposals for law reform and a series of open questions concerning potential options forlaw reform.We received over 650 responses to that public consultation from a wide range ofstakeholders, including health professionals, social workers, legal professionals,campaigning organisations and members of the public, as well as people who had beenpersonally involved in surrogacy, such as surrogates, intended parents, and adultchildren born through surrogacy or donor conception.We are currently analysing the responses to our consultation and developing policy. Wewill use the points raised in the public consultation to inform our final recommendationsto Government.At that stage, we will also conduct an impact assessment of our recommendations,including looking specifically at the impact on equality. This will consider, among otherfactors, the costs and benefits to the family justice system and the National HealthService of any reform.We expect to produce a final report with our recommendations for reform of the law, anda draft Bill, in early 2022. We have not yet made any recommendations to Governmentconcerning surrogacy.Concerns about accessibility of the Consultation PaperWe acknowledge that our Consultation Paper was lengthy. However, there are a numberof reasons this was unavoidable in light of the aim and scope of the project – which isintended to design a comprehensive new system for surrogacy law. We conduct publicconsultations with a view to gathering sufficient information to produce a draft Bill forGovernment to consider. I suspect so. 😉The whole thing is very gay driven. Have you listened to any podcasts with Renate Klein? She pulls no punches. I’ll find one to link. The thing is, in USA contracts are totally property law based, the buyers one the fetus, the surrogate mother is gestating their property. It’s all about them. I suspect these guys at the LC have used the USA as a starting point to look at how to give buyers similar protections. They have belatedly added Penney Lewis to the team, she has a background in medical ethics, but I don’t hold out too much hope of her taking a different view. @KateKnit @HebrideanHecate @NordicModelNow

Surrogacy comes under Property, Family and Trust Law and he is the commissioner for that.
