A number of you have asked questions about DPS' stand relating to HB 2074 (eliminates the renewal training requirement), particularly, about the below alert from AzCDL (shortened) and the "amendment". From AzCDL: Congratulations! Your activism paid off again. AzCDL supported HB 2074 passed out of the Senate Judiciary committee on Monday, February 27, 2006 with a favorable amendment added by the Committee Chairman, Senator Huppenthal. The language in the amendment is supported by DPS. The original version of HB 2074 has already passed the full House. It has now passed the Senate Judiciary committee by a vote of 6-1. From here, it's headed to the Senate Committee of the Whole. I will explain the amendment. In October of 2005, Sen. Huppenthal made an inquiry to DPS regarding AZ CCW reciprocity laws and requested suggestions. I was asked to make a recommendation and it was returned to Sen Huppenthal's office (with the approval of DPS). While the recommendation didn't go anywhere initially, DPS recently again discussed this issue with a member of the legislature and the "amendment" was added to HB 2074. The "amendment" you see below is the result. Essentially, I recommended scrapping the existing (and confusing) language in ARS 13-3112 pertaining to recognition/reciprocity and adopting universal recognition of all CCW permits, with minimal requirements. I also sought additional protections for the privacy of applicants, permit holders and instructors. This state and any political subdivision of this state shall recognize a concealed weapon, firearm or handgun permit or license that is issued by another state or a political subdivision of another state if both: 1. The permit or license is recognized as valid in the issuing state. 2. The permit or license holder is all of the following: (a) Not a resident of this state. (b) Legally present in this state. (c) Not legally prohibited from possessing firearms IN THIS STATE. V. For the purpose of establishing mutual permit or license recognition with other states, the department of public safety shall enter into a written agreement if another state requires a written agreement." While the majority of you have been hoping for universal permit recognition in AZ, the unfortunate aspect of these events is that the "amendment" was added to a bill that DPS does not support. In my opinion, the only way DPS will support the amended version of HB 2074 is if the renewal training requirement is restored. Of course, it doesn't mean the bill won't pass just because DPS opposes it, it simply means there will be more resistance. The bill now goes to the Senate Committee of the Whole.
