    Ms. Collins (for herself, Mr. Conrad, Mr. Gregg, Mr. Burns, Mr. 
 Hutchinson, Mr. Enzi, Mr. Roberts, Mr. Allard, Mr. Hagel, Mr. Dorgan, 
 Mr. Thomas, and Mr. Johnson) introduced the following bill; which was 
 read twice and referred to the Committee on Health, Education, Labor, 
                              and Pensions

                                 A BILL


 
To reauthorize the Rural Education Initiative in subpart 2 of part J of 
     title X of the Elementary and Secondary Education Act of 1965.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. RURAL EDUCATION INITIATIVE.

    Subpart 2 of part J of title X of the Elementary and Secondary 
Education Act of 1965 (20 U.S.C. 8291 et seq.) is amended--
            (1) in section 10973--
                    (A) by inserting ``(a) In General.--'' before 
                ``There are'';
                    (B) by striking ``$62,500,000 for fiscal year 
                2001'' and inserting ``$150,000,000 for fiscal year 
                2002 and each of the 4 succeeding fiscal years''; and
                    (C) by adding at the end the following:
    ``(b) Funding Ineligibility.--For any fiscal year for which the 
amount appropriated under subsection (a) is greater than or equal to 
$100,000,000, any local educational agency that receives a grant under 
section 10975 for the fiscal year shall be ineligible to receive any 
grant funds awarded on a competitive basis for the fiscal year under 
the following provisions of law:
            ``(1) Subpart 2 of part A of title III.
            ``(2) Subpart 1 of part A of title VII.
            ``(3) Subpart 2 of part A of title VII.
            ``(4) Section 7142.
            ``(5) Part A of title X.
            ``(6) Part B of title X.
            ``(7) Part I of title X.'';
            (2) in section 10974--
                    (A) in subsection (a)(1), by striking ``3134, or 
                section 4116'' and inserting ``4116, or section 6301'';
                    (B) in subsection (b)(2), by inserting ``, except 
                that the Secretary may waive the School Locale Code 
                requirement of this paragraph if the Secretary 
                determines, based on certification provided by the 
                local educational agency or the State educational 
                agency on behalf of the local educational agency, that 
                the local educational agency is located in an area 
                defined as rural by a governmental agency of the 
                State'' before the period; and
                    (C) in subsection (c), by inserting ``and section 
                307 of the Department of Education Appropriations Act, 
                1999,'' after ``and VI,''; and
            (3) in section 10975--
                    (A) in subsection (a), by striking ``3134, or 
                section 4116'' and inserting ``4116, or section 6301''; 
                and
                    (B) in subsection (b)(2), by inserting ``, except 
                that the Secretary may waive the School Locale Code 
                requirement of this paragraph if the Secretary 
                determines, based on certification provided by the 
                local educational agency or the State educational 
                agency on behalf of the local educational agency, that 
                the local educational agency is located in an area
