A BILL
To amend title XIX of the Social Security Act to provide States with
the option of covering intensive community mental health treatment
under the Medicaid Program.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Medicaid Intensive Community Mental
Health Treatment Act of 2001''.
SEC. 2. PROVIDING STATES WITH THE OPTION OF COVERING INTENSIVE
COMMUNITY MENTAL HEALTH TREATMENT UNDER THE MEDICAID
PROGRAM.
(a) In General.--Section 1905 of the Social Security Act (42 U.S.C.
1396d) is amended--
(1) in subsection (a)--
(A) by striking ``and'' at the end of paragraph
(26);
(B) by redesignating paragraph (27) as paragraph
(28); and
(C) by inserting after paragraph (26) the following
new paragraph:
``(27) intensive community mental health treatment (as
defined in subsection (x)) for adults with diagnosed severe and
persistent mental illness, and for children with diagnosed
serious mental and emotional disturbances (manifested by
substantial functional impairment), who--
``(A) have a history of repeated episodes of
psychiatric hospitalization or are high users of
emergency and inpatient hospital services;
``(B) have been arrested repeated times for minor
offenses;
``(C) have a history of poor outcomes from
provision of, or lack of access to, less intensive
mental health services;
``(D) cannot meet their own basic needs and live in
substandard housing situations, including being
homeless; or
``(E) have a history of coexisting substance use of
at least a 12-month duration;''; and
(2) by adding at the end the following new subsection:
``(x)(1) The term `intensive community mental health treatment'
means all of the following mental health services provided in a
coordinated manner:
``(A) 24-hour, 7-day-a-week intensive case management,
including assertive community treatment.
``(B) Psychiatric rehabilitation.
``(C) Integrated treatment services for individuals with
co-occurring mental illness and substance abuse disorders.
``(D) Crisis residential treatment (as defined in paragraph
(2)).
``(E) Psychiatric support services for individuals residing
in supported housing facilities.
``(F) Psychiatric hospital discharge planning (as defined
in paragraph (3)).
``(G) Medication education and management.
``(H) Family psycho-education services.
``(I) Other evidenced-based intensive community mental
health treatment.
``(2) The term `crisis residential treatment' means services (other
than inpatient psychiatric services) that provide 24-hour a day
intervention to individuals experiencing severe emotional distress.
``(3) The term `discharge planning' means, with respect to a
psychiatric hospital, the process that includes--
``(A) identification of an individual's needs for
treatment, housing, and support services in the community after
discharge from the hospital;
``(B) establishment of a plan to develop appropriate
linkages between the hospital and the community to meet such
needs; and
``(C) implementation of the plan at the point of discharge
from the hospital.''.
(b) Effective Date.--The amendments made by this section apply to
treatment furnished on or after January 1, 2002.
