A BILL
To authorize the President to reduce or suspend duties on textiles and
textile products made in Pakistan until December 31, 2004.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Pakistan Emergency Economic
Development and Trade Support Act''.
SEC. 2. TARIFF AUTHORITY.
(a) Authority To Reduce or Suspend Duties.--Notwithstanding any
other provision of law, the President may proclaim such reduction or
suspension of any existing duty on imports of textiles and textile
products that are produced or manufactured in Pakistan as he determines
to be appropriate in response to the threat to national security posed
by international terrorism. Such reduction or suspension shall be
limited in duration to no more than one year, but may be extended or
limited through subsequent proclamation.
(b) Threat to National Security Posed by International Terrorism.--
Such action may be proclaimed only if the President determines--
(1) international terrorism continues to be a threat to the
national security of the United States;
(2) the assistance of Pakistan is critical to addressing
this threat; and
(3) Pakistan is incurring or may incur substantial economic
harm as a direct consequence of assisting in addressing this
threat, including efforts taken to comply with United Nations
resolutions relating to threats to international peace and
security caused by terrorist acts, in particular United Nations
Security Council Resolution 1373 (2001).
(c) Consultation and Layover Requirements.--Such action may be
proclaimed only if--
(1) the President has notified the Committee on Ways and
Means of the House of Representatives and the Committee on
Finance of the Senate of--
(A) the action proposed to be proclaimed and the
reasons for such actions, and
(B) the determinations made under subsection (b);
(2) a period of 30 calendar days, beginning with the first
day on which the President has met the requirements of
paragraph (1) with respect to such action, has expired; and
(3) the President has consulted with such committees
regarding the proposed action during the period referred to in
paragraph (2).
(d) Textiles and Textile Products.--The term ``textiles and textile
products'' means a good that is listed in the Annex to the Agreement on
Textiles and Clothing referred to in section 101(d)(4) of the Uruguay
Round Agreements Act.
(e) Termination.--Any reduction or suspension of duty under
subsection (a) shall terminate no later than December 31, 2004.
