Mr. Pombo introduced the following bill; which was referred to the
Committee on Transportation and Infrastructure

A BILL
To prohibit the use of Federal funds for any program that restricts the
use of any privately owned water source.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. FINDINGS.
The Congress finds the following:
(1) Some State and local governments restrict the use of
privately owned water sources and impose fees on the owners of
such sources for connection to or use of a public water supply.
(2) Although State and local governments generally cite
health and safety concerns in support of such restrictions, the
actual governmental concern is often obtaining additional funds
for the public water supply.
(3) By failing to respect the preferences of private water
source owners for using their own water sources, State and
local governments adversely affect competition in the
marketplace and contribute to higher costs for property owners,
rural businesses, and farms.
(4) By funding State or local water resource programs, the
Federal Government may impose unnecessary burdens on property
owners, rural businesses, and farms.
SEC. 2. RESTRICTION ON USE OF FEDERAL FUNDS.
Federal funds may not be used for any governmental program that
restricts the use of any privately owned water source, unless such
source is specifically found by the head of the governmental entity
that imposes the restriction to pose a risk to human health.
