A BILL
To amend the National Labor Relations Act to permit elections to
decertify representation by a labor organization.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Workers Access to Accountable
Governance in Employment (WAGE) Act''.
SEC. 2. DECERTIFICATION ELECTION PERMITTED.
Section 9 of the National Labor Relations Act (29 U.S.C. 159) is
amended by adding at the end the following new subsection:
``(f) Notwithstanding any current collective bargaining
relationship or current collective bargaining agreement between an
employer and a labor organization, upon the filing with the Board, by
30 percent or more of the employees in a bargaining unit, of a petition
alleging that they no longer wish to be represented by the certified or
recognized labor organization, the Board shall, not later than 50 days
after the filing of such petition, conduct an election by secret ballot
of the employees in such unit and certify the results thereof to such
labor organization and to the employer. No decertification election
shall be held under this subsection in any bargaining unit within
which, in the preceding 12-month period, a valid decertification
election shall have been held.''.
