A BILL
To amend the Elementary and Secondary Education Act of 1965 to
eliminate the funding limitation applicable to grants for special
alternative instructional programs under subpart 1 of part A of title
VII of such Act.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``English Language Acquisition Funding
Fairness Act''.
SEC. 2. REPEAL.
Section 7116(i) of the Elementary and Secondary Education Act of
1965 (20 U.S.C. 7426(i)) is amended--
(1) by amending paragraph (2) to read as follows:
``(2) Equal treatment for special alternative instructional
programs.--In awarding grants and distributing funds under this
subpart, the Secretary shall not deny an application submitted
by, or reduce funds awarded to, any eligible entity because the
entity seeks to implement a special alternative instructional
program.'';
(2) by striking paragraph (3); and
(3) by redesignating paragraphs (4) and (5) as paragraphs
(3) and (4), respectively.
