  To amend title 23, United States Code, to require the allocation of 
   surface transportation program funds for the purchase of recycled 
                               materials.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. ALLOCATION OF SURFACE TRANSPORTATION PROGRAM FUNDS FOR THE 
              PURCHASE OF RECYCLED MATERIALS.

    (a) In General.--Section 133(d) of title 23, United States Code, is 
amended by adding at the end the following:
            ``(6) For purchase of recycled materials.--10 percent of 
        the funds apportioned to a State under section 104(b)(3) for a 
        fiscal year shall be available only for the purchase of 
        recycled materials.''.
    (b) Regulations.--Not later than 90 days after the date of 
enactment of this Act, the Secretary of Transportation shall issue 
regulations to carry out the amendment made by subsection (a).
