A BILL
To amend the Patriot Act to permit an alien lawfully admitted for
permanent residence whose spouse died as a result of a terrorist
activity on September 11, 2001, to apply for naturalization under the
conditions that would have applied if such death had not occurred.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. NATURALIZATION FOR CERTAIN SURVIVING SPOUSES.
The Uniting and Strengthening America by Providing Appropriate
Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT ACT)
Act of 2001 is amended--
(1) by redesignating sections 426 through 428 as sections
427 through 429, respectively; and
(2) by inserting after section 425 the following:
``SEC. 426. NATURALIZATION FOR CERTAIN SURVIVING SPOUSES.
``(a) In General.--In the case of an alien described in subsection
(b), the alien may be naturalized in accordance with section 319(a) of
the Immigration and Nationality Act (8 U.S.C. 1430(a)) notwithstanding
the alien's inability to satisfy the requirement in such section that
the alien, during the three years immediately preceding the date of
filing an application for naturalization, have been living in marital
union with the citizen spouse.
``(b) Aliens Described.--An alien is described in this section if
the alien--
``(1) was an alien lawfully admitted for permanent
residence on September 11, 2001;
``(2) was, at the time of the citizen's death, the spouse
of a citizen of the United States who died as a direct result
of a specified terrorist activity; and
``(3) was not legally separated from the citizen at the
time of the citizen's death.''.
