  To restore oversight of energy derivatives by the Commodity Futures 
  Trading Commission, and maintain the 1993 energy products exemption.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Energy Trading Oversight Act''.

SEC. 2. RESTORATION OF OVERSIGHT OF ENERGY DERIVATIVES BY THE COMMODITY 
              FUTURES TRADING COMMISSION; MAINTENANCE OF THE 1993 
              ENERGY PRODUCTS EXEMPTION.

    (a) In General.--Section 2(h) of the Commodity Exchange Act (7 
U.S.C. 2(h)) is amended by striking paragraphs (3) through (6).
    (b) Conforming Amendments.--
            (1) Section 2(e)(1) of such Act (7 U.S.C. 2(e)(1)) is 
        amended by striking ``, 2(g), or 2(h)(3)'' and inserting ``or 
        2(g)''.
            (2) Section 2(e)(3) of such Act (7 U.S.C. 2(e)(3)) is 
        amended by striking ``or to comply with section 2(h)(5)''.
