A BILL
To amend title 49, United States Code, to require air carriers to
remove from a passenger aircraft any baggage that is checked by a
passenger who does not board the aircraft, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. ENHANCED SAFETY PROCEDURES FOR AIRCRAFT BAGGAGE.
Section 44901 of title 49, United States Code, is amended by adding
at the end the following:
``(d) Enhanced Safety Procedures for Aircraft Baggage.--
``(1) Removal of checked baggage from passenger aircraft.--
Effective on the day following the date of enactment of this
subsection, the Secretary of Transportation shall require an
air carrier to remove from an aircraft for a flight in
passenger air transportation or passenger intrastate air
transportation any baggage that is checked by a passenger on
the flight who does not check-in with a representative of the
air carrier at the appropriate airport gate and board the
aircraft.
``(2) Report on property screening program.--
``(A) In general.--Not later than January 1, 2002,
the Secretary shall transmit to Congress a report
containing a program to provide for the screening of
all property (including checked baggage) on an aircraft
providing passenger air transportation or passenger
intrastate air transportation.
``(B) Contents.--The report shall contain the
Secretary's recommendations for administrative and
legislative actions, including a recommendation as to
whether to continue implementation of the requirements
of paragraph (1) after the implementation of the
screening program described in subparagraph (A).''.
