A BILL
To direct the Secretary of Education, in consultation with the
Secretary of Energy, to establish a 2-year grant program to compensate
schools for rising energy costs.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``School Energy Assistance Act of
2001''.
SEC. 2. GRANT PROGRAM TO COMPENSATE SCHOOLS FOR RISING ENERGY COSTS.
(a) Program Authorized.--Not later than 90 days after the date of
enactment of this section, the Secretary of Education, in consultation
with the Secretary of Energy, shall establish a 2-year grant program to
provide reimbursements under subsection (b) to assist eligible entities
under subsection (c) that have been severely impacted by rising energy
prices.
(b) Reimbursements to Eligible Entities.--To the extent practicable
and subject to the availability of appropriations, the Secretary of
Education shall provide reimbursements to eligible entities under
subsection (c) in an amount up to 50 percent of the amount of the
increase in annual energy costs experienced by the eligible entity for
the academic year involved. In providing such reimbursements, the
Secretary may give priority to eligible entities that have demonstrated
the greatest need for such funds and the strongest commitment to energy
conservation.
(c) Eligible Entity Described.--An eligible entity is a local
educational agency or a Bureau funded school (as such terms are defined
in the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301
et seq.)) that has--
(1) reduced annual energy consumption on a per capita basis
(based on the number of students served) by at least 10 percent
from the previous academic year; and
(2) experienced an increase in annual energy costs of at
least 15 percent over the 1999-2000 academic year (without
regard to the reduction required under paragraph (1)).
(d) Applications.--An eligible entity desiring funds under this
section shall submit an application to the Secretary of Education, in
such form, at such time, and containing such information as the
Secretary may require.
(e) Authorization of Appropriations.--There are authorized to be
appropriated to carry out this section $250,000,000 for each of fiscal
years 2002 and 2003.
