A BILL
To amend title 49, United States Code, to require the operator of Los
Angeles International Airport to mail annual noise mitigation reports
to residents in the area surrounding an airport.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``LAX Noise Community Accountability
Act''.
SEC. 2. ANNUAL NOISE MITIGATION REPORTS BY LOS ANGELES INTERNATIONAL
AIRPORT.
(a) In General.--Subchapter I of chapter 475 of title 49, United
States Code, is amended by adding at the end the following:
``Sec. 47511. Annual noise mitigation reports by Los Angeles
International Airport
``(a) In General.--Before the last day of the first fiscal year
beginning after the date of enactment of this section, and in each
fiscal year thereafter, the operator of Los Angeles International
Airport (in this section referred to as the `operator') shall mail a
noise mitigation report to each household located in the 10-mile radius
of the airport and any additional area covered under a noise
compatibility program developed for the airport under section 47504.
``(b) Contents.--An annual report under subsection (a) shall
include the following information:
``(1) A detailed description of the extent to which noise
in the area surrounding the airport has increased or decreased
during the previous year.
``(2) A list of the dates and times of aircraft arrivals
and departures at the airport that have taken place during
prohibited hours in the previous year.
``(3) A description of all efforts to reduce noise in the
area surrounding the airport, the extent to which these efforts
were successful, and the means and methods used to achieve the
noise reduction.
``(4) A description of all plans to further reduce noise in
the area surrounding the airport, including noise reduction
goals and timetables for achieving these goals.
``(5) Information about the availability of Federal, State,
and local residential noise mitigation funds and the
application procedures for these funds.
``(c) Civil Penalty.--
``(1) In general.--If the operator of Los Angeles
International Airport fails to comply with the requirements of
this section in a fiscal year, the operator shall be liable to
the United States for a civil penalty in an amount determined
by the Administrator of the Federal Aviation Administration.
``(2) Imposition of penalties.--The Administrator shall
impose a civil penalty under this subsection in accordance with
the requirements of section 46301(d).
``(3) Use of amounts.--Any amount collected under this
subsection shall be available to the Administrator for making
grants to non-profit organizations to provide educational
services, health care services, environmental services, speech
and hearing services, and services to persons with disabilities
in communities impacted by noise from Los Angeles International
Airport.''.
(b) Conforming Amendment.--The analysis for subchapter I of chapter
475 of title 49, United States Code, is amended by adding at the end
the following:
``47511. Annual noise mitigation reports by Los Angeles International
Airport.''.
