A BILL
To amend title 35, United States Code, to direct the Director of the
Patent and Trademark Office to adjust fees charged by the Office so
that the fees collected in any fiscal year will equal, to the greatest
extent practicable, the amount appropriated to the Office for that
fiscal year.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. PATENT FEES.
(a) Adjustment of Patent Fees.--Section 42 of title 35, United
States Code, is amended by adding at the end the following new
subsection:
``(f) Notwithstanding the fees prescribed under subsections (a),
(b), and (d) of section 41, and notwithstanding section 41(f) of this
title and section 31 of the Trademark Act of 1946, the Director shall
adjust the fees charged by the Office in each fiscal year so that the
amount of fees collected by the Office in that fiscal year will equal,
to the greatest extent practicable, the amount of funds appropriated to
the Office for that fiscal year.''.
