A BILL
To prohibit any Federal agency from issuing or enforcing certain rules
that may be applied to restrict the transportation or possession of a
firearm on a public Federal road.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. RULES RESTRICTING TRANSPORTATION OR POSSESSION OF FIREARMS
ON FEDERAL ROADS.
(a) In General.--No Federal agency may issue or enforce any rule
that may be applied to restrict the transportation or possession of a
firearm by a person at a location on a public Federal road, unless--
(1) the rule is less restrictive than or equally
restrictive as State laws and rules that apply to such
transportation or possession; or
(2) the Secretary of Defense, for reasons of national
defense, publishes a determination that the restriction under
this subsection on issuing and enforcing rules should not apply
to such transportation or possession.
(b) Conspicuous Notice.--If the Secretary publishes a determination
under subsection (a)(2) for a location on a public Federal road, the
Secretary shall post signs that give conspicuous notice to a person
traveling at that location that the transportation or possession of a
firearm on such road may be subject to Federal restrictions that are
more restrictive than the States laws and rules that would otherwise
apply. The head of the Federal agency with administrative jurisdiction
over the location shall allow the Secretary to post such signs.
(c) Definitions.--For purposes of this section:
(1) Agency.--The term ``agency'' has the same meaning given
to that term under section 551 of title 5, United States Code.
(2) Firearm.--The term ``firearm'' has the same meaning
given to that term under section 921 of title 18, United States
Code, except that the term includes an antique firearm (as that
term is used in that section).
(3) Public federal road.--The term ``public Federal
road''--
(A) means any road that--
(i) is accessible to the public;
(ii) is located on federally owned or
administered property; and
(iii) is generally usable for travel
between points that are not located on that
property; and
(B) includes areas adjacent and related to such
road, including such areas that are scenic overlooks or
rest areas.
(4) Secretary.--The term ``Secretary'' means the Secretary
of Defense.
