Mr. Filner introduced the following bill; which was referred to the

A BILL
To amend chapter 51 of title 38, United States Code, to pay certain
benefits received by veterans through the date of their death rather
than through the last day of the preceding month.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. VETERANS BENEFITS PAID THROUGH DATE OF DEATH.
(a) Discontinuances at Death.--Section 5112(b) of title 38, United
States Code, is amended--
(1) by redesignating paragraphs (1) through (10) as
paragraphs (2) through (11), respectively;
(2) by inserting before paragraph (2), as so redesignated,
the following new paragraph:
``(1) by reason of the death of a payee who was a veteran
shall be the day before such death;''; and
(3) by amending paragraph (2), by striking ``, or death of
a payee'' and inserting ``of a payee, or by reason of death of
a payee who was not a veteran,''.
(b) Conforming Amendment Relating to Receipt of Benefits by
Surviving Spouse.--Section 5110(d) of such title is amended in
paragraphs (1) and (2) by striking ``first day of the month in which
the death occurred'' and inserting ``date of death''.
