To amend title 37, United States Code, to ensure that the rates of the 
   basic allowance for housing for military housing areas inside the 
 United States are sufficient to eliminate out-of-pocket housing costs 
                 for members entitled to the allowance.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Military Housing Fairness Act of 
2001''.

SEC. 2. USE OF BASIC ALLOWANCE FOR HOUSING TO ELIMINATE OUT-OF-POCKET 
              HOUSING COSTS FOR MEMBERS.

    Section 403(b)(1) of title 37, United States Code, is amended by 
adding at the end the following new sentence: ``In prescribing the 
rates of the basic allowance for housing under this subsection, the 
Secretary of Defense shall ensure that the rates are sufficient to 
eliminate, not later than September 30, 2003, out-of-pocket housing 
costs for members entitled to the allowance to obtain adequate housing 
in that military housing area.''.
