                                 A BILL


 
    To provide for the implementation of the agreement between the 
 Secretary of the Interior and the Governor of Arizona to facilitate a 
land exchange of Federal and State lands between the United States and 
the State of Arizona pending a State referendum regarding the agreement 
                                in 2002.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. CONSTITUTIONAL AUTHORITY.

    The constitutional authority on which this Act rests is the power 
of Congress to dispose of and make all needful Rules and Regulations 
respecting the Territory or other Property belonging to the United 
States, as enumerated in article IV, section 3 of the United States 
Constitution, and the power of Congress to make all laws which are 
necessary and proper for carrying into execution the powers vested by 
the Constitution in the Government of the United States, or in any 
Department or officer thereof, as enumerated in article I, section 8 of 
the Constitution.

SEC. 2. PREPARATION FOR FUTURE LAND EXCHANGE BETWEEN THE STATE OF 
              ARIZONA AND THE UNITED STATES.

    (a) Definition.--In this section, the term ``Agreement'' means the 
Agreement to Facilitate a Land Exchange of Federal and State Lands 
Between the United States of America and the State of Arizona entered 
into by the Secretary of the Interior and the Governor of Arizona on 
October 20, 2000.
    (b) Purpose.--It is the purpose of this section to provide for the 
implementation of a land exchange between the United States and the 
State of Arizona according to the Agreement at such time as the 
exchange can be legally accomplished.
    (c) Activities of the Secretary of the Interior.--(1) Pending the 
results of a referendum regarding the Agreement conducted in the State 
of Arizona during 2002, the Secretary of the Interior, in cooperation 
with the Governor of Arizona, shall proceed with the implementation of 
section 5 and the other provisions of the Agreement, except the actual 
conveyance or acquisition of real property by the United States under 
the Agreement.
    (2) The Secretary shall complete the appraisal process agreed to in 
section 6 of the Agreement before the referendum referred to in 
paragraph (1) is conducted.
    (d) Referendum.--(1) If a referendum is held regarding the 
Agreement during 2002 and the land exchange contemplated by the 
Agreement is authorized, the parties to the Agreement shall complete 
the implementation of the Agreement.
    (2) If a referendum is not held regarding the Agreement during 
2002, or such a referendum is held during 2002 but the land exchange 
contemplated by the Agreement is rejected, the rights of each party to 
the Agreement with respect to real property under consideration for 
inclusion in the land exchange shall return to the status in existence 
on the day before the date of the enactment of this Act.
