and Mr. Doolittle) introduced the following bill; which was referred to
the Committee on Ways and Means

A BILL
To amend title II of the Social Security Act to eliminate the earnings
test for individuals who have attained age 62.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
The Act may be cited as the ``Social Security Earnings Limit Repeal
Act of 2001''.
SEC. 2. ELIMINATION OF EARNINGS TEST FOR INDIVIDUALS WHO HAVE ATTAINED
AGE 62.
(a) In General.--Section 203 of the Social Security Act (42 U.S.C.
403) is amended--
(1) in subsection (c)(1), by striking ``retirement age (as
defined in section 216(l))'' and inserting ``the age of 62'';
(2) in paragraphs (1)(A) and (2) of subsection (d), by
striking ``retirement age (as defined in section 216(l))'' each
place it appears and inserting ``the age of 62'';
(3) in subsection (f)(1)(B), by striking ``was at or above
retirement age (as defined in section 216(l))'' and inserting
``was age 62 or above'';
(4) in subsection (f)(3)--
(A) by striking ``33\1/3\ percent'' and all that
follows through ``any other individual,'' and inserting
``50 percent of such individual's earnings for such
year in excess of the product of the exempt amount as
determined under paragraph (8),''; and
(B) by striking ``retirement age (as defined in
section 216(l))'' and inserting ``age 62'';
(5) in subsection (f)(8)(E), by striking ``retirement age
(as defined in section 216(l))'' and inserting ``age 62'';
(6) in subsection (h)(1)(A), by striking ``retirement age
(as defined in section 216(l))'' each place it appears and
inserting ``age 62''; and
(7) in subsection (j)--
(A) in the heading, by striking ``Retirement Age''
and inserting ``Age 62''; and
(B) by striking ``having attained retirement age
(as defined in section 216(l))'' and inserting ``62
years of age''.
(b) Conforming Amendments Eliminating the Special Exempt Amount for
Individuals Who Have Attained Retirement Age.--
(1) Single exempt amount.--Section 203(f)(8) of such Act
(42 U.S.C. 403(f)(8)) is amended--
(A) in subparagraph (A), by striking ``the new
exempt amounts (separately stated for individuals
described in subparagraph (D) and for other
individuals) which are to be applicable'' and inserting
``a new exempt amount which shall be applicable'';
(B) in the matter in subparagraph (B) preceding
clause (i), by striking ``Except'' and all that follows
through ``whichever'' and inserting ``The exempt amount
which is applicable for each month of a particular
taxable year shall be whichever'';
(C) in clauses (i) and (ii) of subparagraph (B), by
striking ``corresponding'' each place it appears; and
(D) in the last sentence of subparagraph (B), by
striking ``an exempt amount'' and inserting ``the
exempt amount''.
(2) Elimination of rules for computing special exempt
amount.--Section 203(f)(8) of such Act (42 U.S.C. (f)(8)(D)) is
amended further--
(A) by striking subparagraph (D);
(B) by redesignating subparagraph (E) (as amended
by subsection (a)(5)) as subparagraph (D); and
(C) in subparagraph (D) (as redesignated), by
striking ``Notwithstanding subparagraph (D), no'' and
inserting ``No''.
(3) Maintenance of current rules for disability benefits.--
Section 223(d)(4)(A) of such Act (42 U.S.C. 423(d)(4)(A)) is
amended by inserting ``and section 2 of the Social Security
Earnings Limit Repeal Act of 2001'' after ``section 102 of the
Senior Citizens' Right to Work Act of 1996''.
SEC. 3. EFFECTIVE DATE.
The amendments made by this Act shall apply with respect to taxable
years ending after December 31, 2001.
