A BILL
To ensure that schools develop and implement comprehensive school
safety plans.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Comprehensive School Safety Act''.
SEC. 2. PROGRAM AUTHORIZED.
The Secretary of Education is authorized to provide grants on a
competitive basis to State educational agencies to enable schools to
develop and implement comprehensive school safety plans.
SEC. 3. GRANT AWARD.
(a) State Application.--To be eligible to receive a grant award
under this Act, a State educational agency shall submit an application
to the Secretary at such time, in such form, and containing such
information as the Secretary may require.
(b) Local Application.--To be eligible to receive a subgrant under
this Act, a local educational agency shall submit an application to the
State educational agency in such form and containing or accompanied by
such information as the State educational agency shall require.
(c) Contents.--An application submitted under subsection (a) or (b)
shall include assurances that--
(1) funds provided under this Act shall supplement, not
supplant, State and local funds;
(2) an applicant that receives funds under this Act may use
not more 1.5 percent of the funds to pay administrative
expenses;
(3) in the case of a local educational agency, such agency
shall provide parents, students, faculty, school
administrators, and any other individuals or groups an
opportunity to present their views and make recommendations
regarding the development and implementation of a safety plan
at each school served by the agency; and
(4) in the case of a State educational agency, such agency
shall evaluate the effectiveness of each school safety plan on
an annual basis.
SEC. 4. USES OF FUNDS.
A local educational agency that receives a subgrant award under
this Act shall use such grant funds to--
(1) assess the current status of school crime committed on
school campuses and at school-related functions;
(2) identify appropriate strategies and programs that will
provide or maintain a high level of school safety; and
(3) provide each school served by such agency a safe and
orderly environment conducive to learning.
SEC. 4. DEFINITIONS.
As used in this Act:
(1) Local educational agency.--The term ``local educational
agency'' has the same meaning given such term in section 14101
of the Elementary and Secondary Education Act of 1965 (20
U.S.C. 8801).
(2) Outlying area.--The term ``outlying area'' means the
United States Virgin Islands, Guam, American Samoa, the
Commonwealth of the Northern Mariana Islands, the Republic of
the Marshall Islands, the Federated States of Micronesia, and
the Republic of Palau.
(3) Secretary.--The term ``Secretary'' means the Secretary
of Education.
(4) State.--The term ``State'' means each of the 50 States,
the District of Columbia, the Commonwealth of Puerto Rico, and
each outlying area.
SEC. 5. AUTHORIZATION OF APPROPRIATIONS.
There are authorized to be appropriated to carry out this Act
$50,000,000 for fiscal year 2002 and such sums as may be necessary for
each of the four succeeding fiscal years.
