Update: SCOTUS Just Turned “No Guns Allowed” Into “Guns Allowed Unless You Object” [1] ['Ade', 'A Pagan In Arizona', 'Meteor Blades', 'Chitown Kev'] Date: 2026-06-25 The Supreme Court’s new decision in Wolford v. Lopez is exactly the warning I raised in my original story: the Court is using the Second Amendment to flatten local judgment into one national command. In Wolford, the Court struck down Hawaii’s rule requiring express permission before licensed concealed-carry permit holders could bring handguns onto private property open to the public. In plain English, Hawaii tried to set the default at: no guns on private property open to the public unless the owner affirmatively says yes. The Court said no. The constitutional default must now favor carry unless the property owner takes steps to say otherwise. That is not public order. That is gun anarchy imposed as “rights.” The most revealing part is the Court’s federalization logic. The majority says the Second Amendment has the same meaning everywhere — Hawaii, New York, Chicago, Montana, Alaska — regardless of local conditions, local culture, local density, local risk, or local democratic judgment. That is the hardcoded-variable fallacy I warned about. A rural homestead and a crowded city corridor are not the same operating environment. A private ranch, a gas station, a grocery store, a coffee shop, a laundromat, and a dense urban commercial district do not all present the same risk profile. But under this Court’s doctrine, states and cities are being told that their own public-safety calibration must yield to a nationalized Second Amendment command. And once again, the machinery is Bruen. Modern laws are dragged through a historical keyhole. Property rules are subordinated to judicial gun doctrine. Local judgment is treated as constitutional defiance. The majority frames this as protecting self-defense. But the practical effect is to make guns harder to exclude from everyday public life unless property owners affirmatively post signs, give express consent, or navigate legal uncertainty. That shifts the burden away from the person carrying the weapon and onto everyone else — business owners, customers, workers, families, and communities. That is not judicial restraint. It is judicially imposed deregulation. And this is the deeper danger: these judicial anarchists are no longer claiming supremacy only over law. They are now claiming supremacy over history itself. The majority does not merely interpret the Second Amendment. It decides which fragments of 18th- and 19th-century history count, which local traditions are too local, which analogues are too weak, which laws are too late, and which public-safety judgments must be discarded. That is not neutral history. That is judicial power wearing a historian’s costume. Under this doctrine, elected lawmakers do not just lose the authority to balance rights and safety. They are forced to litigate the past before they can govern the present. That is the madness of Bruen: history becomes a veto, and the Court appoints itself both constitutional referee and national historian. And it proves the central thesis of the original story: Republicans and the Supreme Court are not merely defending gun rights. They are building a system where public-safety guardrails are treated as constitutional violations, local police powers are narrowed, and gun-carry defaults are imposed from Washington on communities that should be able to govern their own risk. Democrats should say so plainly. This is not “control vs. rights.” It is public order vs. gun anarchy. And with Hemani one week and Wolford the next, the Court is making the point faster than Democrats are naming it.
