Presidential Qualification Clause [1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2026-04-04 Continuing with the challenge that Mercy Ormont issued in “What's next? My take on necessary Amendments and legislation”, following is another proposed enhancement to the Constitution that may help prevent future disasters that have resulted from the second term of Donald Trump. At least eight States attempted to prevent Donald Trump from being on the ballot for the 2024 election, however frequently the Supreme Courts of the individual States and separately the Supreme Court of the United States overruled the petitions to prevent Donald Trump from running for President, and the reason appears to be reasonable in that not having a uniform set of requirements across the entirety of the United States would make it impossible to conduct a coherent and enforceable election. Therefore clarity must be included in the Constitution itself, and it is suggested that a clarification be added as proposed below: Article II, Section 1, Clause 5: No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States. Further, no person is eligible to the Office of President if they have: 1) advocated the overthrow of our constitutional form of government 2) failed to support and defend the Constitution 3) been found guilty of treason 4) been found guilty of bribery, corruption, homicide 5) been found guilty of other serious crimes including (but not limited to) violent crimes such as assault, property crimes, white-collar crimes, and public order crimes 6) potentially profit from a conflict of interest as to performing the duties of the President and benefit(s) of a personal interest 7) an issue of a personal nature that may present the opportunity for blackmail or other threat of intimidation or coercion.
