[1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2024-11-26 Various media outlets have picked a quotation out of Jack Smith’s team’s filing stating that: ““the Constitution requires that this case be dismissed before the defendant is inaugurated,” But where exactly is the text of the constitution that supports this? This quote seems to be conflating INTERPRETATIONS of the constitution with the constitution itself. Our current supreme court has made it clear that 50 and even 100-year-old interpretations ARE NOT settled law. And this particular interpretation, the interpretation that a president cannot be indicted or prosecuted, was solicited by then president Nixon himself, from his own justice department, as a way to shield himself from indictment. This particular interpretation has been suspect for years. But today, suddenly, it’s so trusted we’ll just pretend it’s actually part of the constitution and that’s what we are following. And how funny is it that today we even entertain the idea that presidents can pardon themselves, when back then Nixon knew he had to resign and have Ford pardon him?
