Judge Merchan’s delaying Trump’s sentence may put Trump in prison. [1]

At first blush, Judge Merchan decision to delay Trump’s sentence until after the election appears to be a victory for Trump. However, if Trump loses the election, and is no longer a Presidential candidate at the time of sentencing, that will take a lot of pressure off Judge Merchan and he may be more likely to give Trump a sentence of imprisonment.

Andrew Weissmann just said the same thing on MSNBC.

However, if by chance, Trump wins the election, and is now the President-elect, that will place Judge Merchan in a different dilemma. Will he sentence a President-elect to prison less than two months before he is inaugurated ?

Would it be in the national interest to have the President-elect released from prison on the morning of Inauguration Day so he could go to Washington DC to be sworn in as President by Chief Justice Roberts?

I am betting Trump will lose the election and be sentenced to prison.
