Reining in the Supreme Court-Excellent Salon Article [1]

Paul Rosenberg at Salon has an excellent article on How Kamala Harris can fight the renegade Supreme Court — and win.

The article discusses the dimensions of the problem caused by the extraordinary usurpation of power by SCOTUS, and then goes into a range of potential solutions.

Expansion and term limits are discussed (“personnel” reforms), but the main thrust is that the best avenue is a “disempowering” reform as described in Article III, Section 2, Clause 2 of the constitution, which explicitly allows Congress to make exceptions to the Supreme Court’s appellate jurisdiction. This so-called “jurisdiction stripping” could be added to a host of progressive legislation, shielding it from SCOTUS review.

It is well worth a read.

I found the article to be very informative, and hopeful. I sincerely hope a new Harris administration and Democratic Congress will think and act along these lines.
