This is not unexpected, given the way Judge Cannon has handled the case, giving every leeway and consideration to the defense lawyers.

trumps lawyers have been hammering away on the argument that the special counsel was unlawfully appointed and Cannon delivered.

Cannon also wrote —

The Framers gave Congress a pivotal role in the appointment of principal and inferior officers. That role cannot be usurped by the Executive Branch or diffused elsewhere—whether in this case or in another case, whether in times of heightened national need or not.

This seems to follow the standard republican tack to weaken Presidential powers when a Democrat occupies the White House and to strengthen it when a republican does.

No doubt, Cannon’s dismissal of the case was influenced by SCOTUS Justice Thomas who in the trump immunity case suggested that the special counsel was unlawfully appointed.
