Jack Smith Should Consider Dropping the Docs Case [1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2024-02-27 While the NY docs case appears to be going forward next month, the other three cases are mired in judicial proceedings. The Jan 6 case is in limbo while SCOTUS decides if Trump has immunity to prosecution. The Fulton County RICO case was expected to take a year, if it ever gets started. The docs case is scheduled to go forward in May, but Trump has claimed immunity there too. And now we learn that the Trump team has a plan: Former President Donald Trump’s lawyers see a major opportunity this week to use his criminal document mishandling case in Florida to create an impasse on his calendar for the two federal judges overseeing his major criminal cases. Juggling his campaign and court calendar and playing his cases off one another is a key part of Trump’s legal strategy. The ultimate goal, his team has said openly, is to prevent Trump from being tried in federal court before voters cast their ballots in the 2024 general election. A primary aim for Trump’s legal team, according to people familiar with the strategy, is to put the judge in DC overseeing the 2020 federal election obstruction case, Tanya Chutkan, in a position where she can’t start a trial before Election Day. We’ve all seen that Cannon has a thumb on the scale. And I believe the only way this trial goes forward is IF she can preempt the Jan 6 trial- the trial that matters most. If Jack Smith a choice between the Docs case, tried in MAGAland by a corrupt judge OR the Jan 6 case, tried in DC by a respectable judge, the calculation is easy. You want the Jan 6 case. And the surest way to get there is dropping the docs case. And we can always try it later- Trump took a LOT of docs.
