I don't think people appreciate what the SCOTUS liberals are doing [1]

Sorry for a short diary but I'm not seeing it elsewhere. The liberals on the Supreme Court don't have the votes to keep Trump off the ballot so they're making sure to save the constitution.

Here's what I mean.

The conservatives REALLY don't want to kick Trump off the ballot. They certainly don't want to help Democrats. They don't want their party to turn against them. And they don't want to be seen as "standing in the way of democracy."

There are a lot of ways that the Court could find that Trump stays on the ballot. They could rule that January 6 wasn't an insurrection. If they do that, it would be very hard to use the insurrection clause again.

They could decide that only Congress can disqualify a candidate. Again, the insurrection clause becomes meaningless, as Congress won't be passing any laws like that any time soon.

Or, they could rule that the insurrection clause doesn't apply to the president. This affects... Trump.

It doesn't affect anyone running for a different office. It doesn't affect anyone who runs for president but has previously held a different office. It doesn't affect anyone who has served in the Military. It affects Trump and Trump only.

The Conservatives on the Court were never going to let Colorado's ruling stand. The job of the liberals needs to be to ensure that the insurrection clause stays intact. Holding that the President is not an officer does the least damage to our constitution while accepting the inevitable.
