Set aside it is legal under US law for someone to enter and surrender to authorities in order to request asylum. The irony of Abbott claiming asylum seekers are 'illegals' is this.

Abbot has no authority to block Border Patrol from going anywhere within 25 miles of the border, including Shelby park. No one does, not a mayor, not a governor, not a private citizen. Border Control can enter your farm, barn, anywhere that's within 25 miles of the border, and they don't even need a warrant.

That's Federal law. It's been upheld repeatedly as within the exclusive authority of the Federal Government over border control under the US Constitution.

What Abbott is doing is using the Texas national guard to obstruct and usurp the lawful exercise of Federal power. In legal parlance, that is known as insurrection.

Section 3 of the 14th Amendment of the United States Constitution says?

Anyone having sworn an oath to support the Constitution who engages in, or aids or abets insurrection is ineligible to hold any state or Federal office.

Section 1 of Article 16 of the Texas Constitution says?

The Governor Texas swears to preserve, protect, and defend the Constitution and laws of the United State.

Time for someone to petition for Abbot's removal from office. I reckon any resident of Texas has standing, as well as DoJ, though I'd prefer a private citizen.

Since it's not an election issue, I magine Federal Court is the place to file.
