[1] ['This Content Is Not Subject To Review Daily Kos Staff Prior To Publication.'] Date: 2024-01-09 Against the wall and cornered, the following possibility occurred to me as one way the Supreme Court majority can get off the hook and still rule against Trump at the same time. It’s not a ruling based on the actual wording of the 14th Amendment, which is abundantly clear. It’s an invented interpretation, something they excel at: “While the 14th Amendment is clear on the reasons for disqualifying any officer of the United States that has taken an oath to support the Constitution, it (the Constitution) also requires than any officer, or any person accused of a crime for that matter, is entitled to a fair trial by a jury of his peers before the charge is proven before it can be applied.” Or words to that effect. Trump then files a dozen more appeals and runs out the clock until the election? If he wins, he pardons himself or in someway stops the prosecutions. Comments and alternative possibilities are welcome.
