Opening a new front in legal battles over college admissions, the U.S. Department of Education has launched a civil rights investigation into Harvard University's policies on legacy admissions. Top colleges' preferential treatment of children of alumni, who are often white, has faced mounting scrutiny since the Supreme Court last month struck down the use of affirmative action as a tool to boost the presence of students of color. — Education Department opens investigation into Harvard's legacy admissions www.wsbtv.com/... In a recent podcast episode, we discussed the conservative-led Supreme Court decision that did away with affirmative action in college admissions. Naturally, the legacy admissions practices came up. Would the SCOTUS decision have an affect on the practice? One would hope that if the idea of doing away with affirmative action was in the pursuit of “fairness” that this unequal admissions practice would be or could be curbed. However, whereas affirmative action was an actual law and or policy, giving preferential treatment to prospective students of legacy families is not written into the schools’ policies but done unofficially in practice. That presents a challenge to putting a stop to it. It would have to be proven that this was actually a standard on-going practice. Another hurdle would be to prove that it wasn’t done by individuals and that it was an approved directive of the institutions themselves. Ironically, affirmative action was rallied against, criticized, and ultimately overturned with opponents claiming it was unfair, racist, and discriminatory of which it was none of those things yet legacy admissions fit all that criteria.
