If that happened, Apple would win the lawsuits and lose the war.  Whether Apple  
has the legalese all setup so they could win such suits is kinda immaterial.   
If a few thousand Mac owners get nailed by Apple over *this* particular issue,  
the result will be that no one will buy Macs anymore.  You ask a company to  
live up to promises made, and they cause you to lose your shirt?  Are you going  
to turn around and buy more products from them?
