I believe that for paper mail, the legalities are long established:  the
addressee owns the physical copy, but the copyright remains with the author.
(A copyright notice is not necessary.)  Publication therefore requires the
author's permission.  Whether this would apply to electronic mail is not
entirely clear, but it seems likely that the courts would consider the
paper-mail precedent applicable.
